Texas submitted this list during court proceedings in Lawrence v. Texas to illustrate how many states had sodomy laws and support Texas’s sodomy statute in dispute.

The dissenting justices disagreed with the Court’s decision, arguing instead that the decision to repeal sodomy laws should remain with the voters of each state and “not [be] imposed by a governing caste that knows best.”
